What is Compliance?

Whether you have lived in Wildcat Ranch for years or only a few days, it is good practice to understand the association's compliance process. The manager inspects the property in full once weekly. If a compliance violation of the CC&R’s is observed, the manager then selects the address, and fills in the appropriate action. Only items outlined in the governance are issues that can be inspected and legally pursued. Below are the actions that may be taken.

First Letter (Friendly Reminder)- The first letter is a friendly reminder notifying the homeowner of the violation observed. The section of the governing documents in violation is quoted in all letters.

Second Letter- The second letter is more direct, requesting that the violation be cured within the annotated time frame.

Third Letter (Final Notice)- The third letter serves as a final and formal demand that they come into compliance, and it is sent via certified and regular mail. On the third letter, we must use the exact wording regarding their right to a hearing, possible attorney’s fees charged to their account, fines, or fees for self-help and time frame to cure the violation. (Chapter 209 of Texas Property Code)

Fine Letter- This is the notice that upon re-inspection, after the above time period has lapsed, that failure to cure the violation has resulted in a fine. Wildcat Ranch Fine Policy states that fines shall be issued on a case by case basis, provided the fine is reasonable in nature. Management cannot waive this fine. If this is a landscape notice, the association may send a commercial crew to the unit and perform the required maintenance and bill that cost to the homeowner in lieu of the fine.

Most compliance violations are resolved with the Friendly Reminder. The friendly reminder is intended as such and is just a letter that essentially expresses, "hey, we noticed something". By the time we re-inspect that issue, it is typically resolved. Legally, we are only required to send the Final Notice. Our management best practice is to send a Friendly Reminder first but if the item is time sensitive then we can jump to the Final Notice. The majority of compliance items every year are landscape related. Simply by mowing, edging, and trimming the front landscaping regularly, you can avoid hearing from us, and save the association some money that we can use to improve the community.
